A legal battle is brewing in the popular tourist destination of Nosara, Costa Rica, as community leaders push for the recovery of approximately 200 acres (80 hectares) of public land. The land, currently managed by a private organization, has been at the center of a dispute regarding its intended use and accessibility to the public.
The Heart of the Matter: Restoring Public Land in Nosara
The conflict centers around land originally designated for communal and environmental use in the 1970s under what was known as the “American Project.” Despite being legally intended for the public benefit, the Nosara Civic Association has administered the land for decades. Many residents feel this has limited access and hindered crucial development opportunities for the community.
A Court Ruling Fuels Hope
On August 8th, the Constitutional Court (Sala IV) sided with an appeal filed by attorney Marvin Rodríguez, who argued that the Municipality of Nicoya had failed to reclaim public land identified as green space in a 2015 government report. The court has given the municipality 18 months – until February 2027 – to complete the land recovery process. This ruling marks a significant victory for the community after years of perceived inaction by the municipality.
Community Action and Demands for Transparency
In response to the ruling, leaders from development associations in various Nosara communities, including Delicias de Garza, Bocas de Nosara, Esperanza Sur, Garza, and Pelada, have requested to actively participate in a working group to oversee compliance and ensure transparency throughout the land recovery process. They are also urging the Attorney General’s Office to lead the legal process, highlighting the land’s crucial environmental, social, and economic importance to the region. The grassroots coalition Alianza por Nosara, comprised of local residents and civic groups, has launched a series of events and fundraising initiatives to support legal advocacy and raise public awareness regarding this issue. This group emphasizes that this case represents more than just a local dispute; it’s a national precedent for safeguarding public assets and promoting sustainable development across Costa Rica. Attorney Rodríguez has requested that the municipality submit monthly, certified progress reports, starting on August 30th and continuing until the February 2027 deadline.
